Terms of Service
Last updated: July 2026
These Terms of Service ("Terms") govern your access to and use of the Brix website at fitbrix.com and any services provided by FitBrix Pty Ltd (ABN 59 634 731 874), trading as Brix ("we", "us", or "our"). By using our website or services, you agree to these Terms.
1. Services
Brix builds autonomous operations infrastructure: intelligent monitoring and automation systems for property, land and remote assets. Our paid engagements run through Brix Systems (agent pipelines and automation builds), and our products, Maisonate, Brix Watch and Brix Edge, operate waitlists and pilot programs ahead of general availability.
2. Eligibility
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent. By using our services, you confirm that you meet these requirements.
3. Use of the Website
You agree to use our website and services only for lawful purposes. You must not:
- Use the site in any way that breaches applicable Australian laws or regulations.
- Attempt to gain unauthorised access to our systems or data.
- Reproduce, duplicate, or resell any part of the website without written permission.
- Transmit any malicious code, spam, or harmful content.
- Misrepresent your identity or business information when contacting or engaging us.
4. Intellectual Property
All content on this website, including the Brix brand, text, graphics, logos, and design, is the intellectual property of Brix and is protected by Australian and international copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
5. Waitlists and Pilot Programs
Joining a waitlist or pilot register does not create an obligation on either side: it records your interest, and consent to be contacted about that product. Places in founding and pilot programs are limited and allocated at our discretion. Product features, pricing and availability described on this website may change before general release.
6. Paid Engagements
Paid services through Brix Systems are subject to separate engagement agreements with specific scope, pricing, timelines, and payment terms. These Terms apply in addition to any engagement agreement.
Results from paid engagements depend on multiple factors including market conditions, implementation quality, and business fundamentals. Past results shared on our website are specific to those clients and are not guaranteed for future engagements.
7. Limitation of Liability
To the maximum extent permitted by Australian law, Brix is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. This includes, but is not limited to, loss of profits, data, business opportunities, or goodwill.
Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Where our services are supplied to you as a consumer within the meaning of the Australian Consumer Law, you may be entitled to a remedy if services fail to meet applicable consumer guarantees.
8. Disclaimer
Our website and services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Third-Party Links
Our website may contain links to third-party websites or services (e.g. scheduling tools, social media platforms). We are not responsible for the content, privacy practices, or availability of these external sites.
10. Analytics and Tracking
We use third-party analytics and advertising technologies to understand how visitors use our website and to measure the performance of our marketing. These currently include Vercel Analytics, and may expand to include the Meta Pixel, Google Analytics, and the Growify Power Pixel. These tools may collect information such as pages viewed, on-site interactions, referring URLs, and device, browser, and IP address details.
Our waitlist and project enquiry forms collect the information described in our Privacy Policy. For details of the cookies and tracking technologies we use, and how to manage or opt out of them, see our Cookie Policy.
11. Termination
We reserve the right to suspend or terminate your access to the website or services at our discretion, without notice, if we believe you have violated these Terms.
12. Governing Law
These Terms are governed by the laws of Western Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our website after changes constitutes acceptance of the updated Terms.
